“All Risks” policies
“All Risks” policies are devised to cover an extensive variety of material and direct damages to insured assets caused by unforeseen and accidental events, except those explicitly excluded in the terms of coverage. However, third party claims defence clauses (for fire damage, for example) which may be included in these policies expressly exclude damages caused by pollution or environmental contamination.
Civil Liability Policies
Traditional civil liability policies protect the policyholder against liability arising from unintentional damage caused to third parties in the course of their business activities. However, these policies often have significant limitations regarding environmental damage. In particular, coverage for environmental damage is generally limited to accidental, unforeseen and clearly identifiable events, and excludes gradual contamination or contamination resulting from prolonged negligence. Moreover, standard civil liability policies may not cover the costs of environmental remediation.
Environmental Liability Policies
To address the shortcomings of “All Risks” and civil liability policies, environmental liability policies offer specific coverage for risks associated with environmental damage. These policies cover:
- Environmental remediation costs: Costs incurred to decontaminate and remediate the environment both on and off the policyholder’s site.
- Third party liability: Damage caused to third parties, including bodily injury and damage to property, resulting from environmental contamination incidents.
- Interrupted operations: Financial losses due to operational interruptions or disruptions in operations resulting from an environmental contamination incident.
- Legal costs: Legal costs related to violations of environmental regulations.
These policies are designed to offer complete protection, covering both accidental and gradual environmental contamination, and ensuring compliance with constantly evolving environmental regulations.
Conclusions
While “All Risks” and civil liability policies offer general coverage for a variety of different risks, they may not be sufficient to address the complex and specific nature of environmental risks. Environmental liability policies provided targeted protection to give businesses the tools they need to manage environmental contamination risks effectively and ensure compliance with applicable legislation.
